1. Agreement to Terms

By accessing or using the Tender Intel platform ("Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not use the Service. Tender Intel is operated by Tender Intel Pty Ltd, based in Melbourne, Australia ("we", "us", "our").

2. Description of Service

Tender Intel provides a subscription-based service that curates and delivers publicly available government and council tender opportunities to registered contractors, subcontractors, consultants, suppliers, and service providers. Our service includes access to a web-based platform and daily email digest notifications.

3. Subscription & Pricing

Access to the Tender Intel platform is provided on a subscription basis at $529 AUD per year (save 10% vs monthly) or $49 AUD per month. A 30-day free trial is available to new subscribers, after which the chosen subscription fee applies.

We reserve the right to change subscription pricing with at least 30 days' notice to existing subscribers. Continued use of the Service after a price change constitutes acceptance of the new pricing.

4. Accuracy of Information

Tender Intel sources tender information from publicly available government portals, council websites, and procurement platforms. While we make every effort to ensure accuracy and timeliness, we do not guarantee that all tender information is complete, current, or error-free. Subscribers are responsible for independently verifying tender details before submitting any bid or expression of interest.

5. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at [email protected] if you suspect any unauthorised use of your account. We reserve the right to terminate accounts that violate these terms.

6. Intellectual Property

All content on the Tender Intel platform, including but not limited to the website design, logos, text, and software, is the property of Tender Intel Pty Ltd and is protected by Australian copyright law. Tender information sourced from government portals remains the property of the respective issuing authorities.

7. Limitation of Liability

To the maximum extent permitted by Australian law, Tender Intel shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of profit, loss of business opportunity, or failure to win a tender. Our total liability to you shall not exceed the subscription fees paid by you in the 12 months preceding the claim.

8. Cancellation & Refunds

You may cancel your subscription at any time by contacting us at [email protected]. Refunds are considered on a case-by-case basis. We do not offer pro-rata refunds for unused portions of an annual subscription unless required by Australian Consumer Law.

9. Governing Law

These Terms and Conditions are governed by the laws of the State of Victoria, Australia. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Victoria.
